PLAY SYSTEM LIMITED WARRANTY & Disclaimer of Warranties (NOT INCLUDING REPOS/USED AND OR DISCOUNTED PLAY SYSTEMS (S) Backyard World LLC/Good Times Play Systems warrants to the original purchaser of the play system(s), provided the play system(s) remains at original delivered location that the portable play system(s) sold hereunder will be warranted of its wooden parts will be free from defects in workmanship and materials for a period of 5 years from the date of build. Play System accessories such as, belt swings, ez ryder, trapeze bar, net swing, and buoy ball are warrantied for 1 year to original purchaser from date of build. Slides are warranted by the manufacture for lifetime to the original purchaser. Surface rust, surface cracking or cracking on wooden components that does not affect the structural integrity of the playset unit are not defects in workmanship or material and are specifically not covered by this limited warranty. Company's entire liability, and the exclusive remedy to purchaser and persons using the playset, shall be at Company's option either to: (a) return the price paid, or (b) repair or replace the section of the playset that does not meet this limited warranty. This limited warranty is void if failure of the playset or any part in the playset has resulted from the misuse, abuse, misapplication, or failure to abide by the required maintenance set forth above. Any replacement of any playset part will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer. There are no other warranties to the maximum extent permitted by law. Company disclaims all other warranties, either express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose, regarding the playset purchase. This limited warranty gives specific legal rights. You may have others which vary from state to state. No liability for consequential damages.

To the maximum extent permitted, by applicable law. In no event shall Company or its employees, agents, or members be liable for any damages whatsoever (including without limitation, special, incidental, consequential, or indirect damages for personal injury, loss of business profits, business interruption or any other pecuniary laws) arising out of the use of or inability to use the playset. In any case, Company's and its employees, agents, and members entire liability under any provision of this agreement shall be limited to the amount actually paid by you for the playset. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. Seller’s sole obligation and purchaser's sole remedy under this Warranty is replacement of the play system(s), or at Seller's option, the defective portion thereof that Seller finds is defective in material or craftsmanship within the warranty time period. Any replacement performed under this Warranty will be performed by Seller or Seller's agent. The above warranty will be null and void in the event that the play system(s) are altered by purchaser, or have been in Seller's sole judgment, subject to negligence, improper maintenance or misuse or moved from original delivered location. Seller’s liability is further limited as provided by the Limitation of Liability section of these terms and conditions.

PLAY SYSTEM MAINTENCE REQUIREMENTS FOR CONSUMER: 1.Re-sealing the playset every 3 to 5 years (depending on the sun & weather conditions) applying a good quality wood preservative. 2.Retighten the nuts on the playset every three months.3.Retighten all bolts on playset every three months. 4.Inspect the playset every three months to make sure it is in safe working condition for children. 5. Remove the belt swings and other accessories during the winter months; this will help preserve the life. 6. Playsets are designed for children five years through twelve years of age except for the approved "toddler swing" that are de- signed for children one year of age. Do not allow children who do not fall within the appropriate designated categories to use the playset. 7. Only children for which the playsets were designed should play on the playsets and then only with parental or adult supervision. Miscellaneous This order and these terms and conditions will be construed under state law without regard to the choice of law principles thereof. No waiver of any breach of any provision of this contract will constitute a waiver of any other breach of such provision. If one or more of these Terms and Condition is for any reason be held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability will not affect any other term or condition and such invalid, illegal, or unenforceable provisions will be modified to the minimum extent necessary to render such provisions valid, legal and enforceable.
